THIRD PARTY ACTIONS WORKPLACE TORTS

THIRD PARTY ACTION CASES

The circumstances surrounding workplace injuries are rarely clearcut. Workers may be seriously injured in accidents that aren't the fault of their employers and therefore they may be entitled to additional benefits and damages.

For example:

  • A delivery driver is seriously injured in a car accident while on his route. Workers' Compensation will provide for his medical treatment and his lost wages, but he may also be able to sue the other driver for additional damages, including pain and suffering.
  • A laborer working for a subcontractor on a construction job receives an electrical shock and is injured because of an electrician's faulty wiring. The worker may be able to sue the electrician or the general contractor for additional damages.
  • A carpenter is blinded when a brand new nail gun misfires. In addition to Workers' Compensation benefits, he may be entitled to other monetary compensation from the manufacturer of the defective nail gun.
  • A member of the nighttime cleaning crew at an office building falls through a rotted floor and breaks her back. She may be able to sue the building owner or the company whose offices was cleaning for her injuries.
