Right to file a lawsuit.
If you were hurt in an auto accident, you have a right to seek compensation for your injuries and the damage to your property via the court system. However, you only have a certain amount of time in which to file a personal injury lawsuit. Failure to meet the deadline ends your claim.
Right to an attorney.
You have the right to hire an attorney and speak with him or her before you answer any questions from the police or any insurance company.
Right to get driver information.
You also have the right to obtain contact and insurance information from the other parties involved in the auto accident.
Right to take photos at the scene.
Taking photos at the scene with your cell phone or other camera is perfectly within your rights and can help clarify exactly what happened during the accident.
Right to obtain a copy of the police report.
If you were a party in an auto accident, you have a right to get a copy of that report from the police department. However, that report may take up to a week to become available.
