Why You Might Need an Attorney for a Workers’ Compensation Case
I want to talk today about reasons. You might need an attorney to help handle your case, or do what an attorney might do in your case. I kind of think of cases as falling into sort of three categories.
Category 1: New Cases That Haven’t Been Accepted or Denied
The first are cases that are new and they haven’t been accepted or denied yet. The workers’ compensation carrier might be paying some benefits, but they haven’t accepted it.
So they’re not locked into it. And so when you’re filing a new case, an attorney can make sure that the forms are filed correctly, that if there is a legal standard you need to meet to make sure your case is accepted, that they do that.
They can help coordinate a recorded statement if that happens, and make sure that when the adjuster’s asking you questions, they’re asking them fairly and that all of the information that needs to be on the record is getting on the record.
Category 2: Denied Cases and the Need for Legal Action
And then there’s accepted cases and denied cases. Denied cases are almost always going to need the help of an attorney, because when a case is denied, your only recourse is to go to court and have a judge issue an order compelling the workers’ compensation carrier to accept your claim. If you’re going to go to court, you’re going to have to give testimony.
There may be other witnesses giving testimony. There will almost certainly be expert witnesses who have to give testimony, and someone needs to make sure that those witnesses are asked the right questions.
The right evidence gets in the record. The right medical records get requested and supplied. And if there’s other evidence that needs to be on the record, it all gets there.
Category 3: Accepted Cases Still Require Oversight
In an accepted case, there’s still quite a lot for an attorney to do.
You may be getting benefits of an accepted case, but are you getting paid the right amount? Depending on how your job works? It may be complicated to figure out what the right amount you should be paid is.
The doctors may be recommending medical treatment. Some of it may be getting approved and scheduled. Some of it may not be. If you finish your treatment, you may need a second opinion.
You want to make sure that you get to a second opinion doctor who’s going to give you a fair evaluation. You want to make sure that that gets scheduled timely. You want to make sure that your case moves along, and it’s prepared and it’s set up to settle or resolve in a way that is most fair to you.
