What Counts as Substance Use in Social Security Disability Claims
If you have substance use—any kind of recreational drug, a drug that’s not prescribed to you but you take anyway, or alcohol use—the judge does have to consider it, if the judge decides that you are disabled.
How Judges Evaluate Sobriety in Social Security Disability Claims
And how they consider that is they decide that if you had a complete period of sobriety would your symptoms improve to the point that you could work.
And if your symptoms would improve to the point that you could work if you stopped using all drugs and alcohol, then your drug and alcohol use is going to be found to be material, and you will be found to be not disabled as a result.
